The Site and Services, including all content, features, and functionality, are owned by PhotoVerse Studio or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Site or Services without the prior written consent of PhotoVerse Studio.
Any photographs or videos produced by PhotoVerse Studio remain the intellectual property of PhotoVerse Studio unless otherwise agreed upon in a separate written agreement.
The fees for PhotoVerse Studio's Services will be outlined in a separate agreement or contract provided to you upon booking. Payment terms, including deposit requirements and payment schedules, will also be specified in the agreement. PhotoVerse Studio reserves the right to change its pricing at any time, but any changes will not affect existing bookings.
Late payments may be subject to interest charges. Failure to make timely payments may result in the cancellation of your booking and forfeiture of any deposits.
Cancellation and rescheduling policies will be outlined in the separate agreement or contract provided to you upon booking. Generally, cancellations made within a certain timeframe may be subject to a cancellation fee. Rescheduling may be subject to availability and additional charges.
PhotoVerse Studio reserves the right to cancel or reschedule a session due to unforeseen circumstances, such as illness or inclement weather. In such cases, PhotoVerse Studio will make reasonable efforts to provide you with alternative dates or a refund of any payments made.
To the fullest extent permitted by applicable law, PhotoVerse Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site or Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Site or Services; (d) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Site or Services by any third party; (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Site or Services; and/or (f) user content or the defamatory, offensive, or illegal conduct of any third party.
In no event shall PhotoVerse Studio's aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Site or Services exceed the amount paid by you to PhotoVerse Studio for the Services in question.
You agree to indemnify and hold harmless PhotoVerse Studio, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Site or Services, your violation of these Terms, or your violation of any rights of another.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Westchester County, New York for the resolution of any disputes arising out of or relating to these Terms or your use of the Site or Services.
PhotoVerse Studio reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site.
